Hi Group,

I'm a do-it yourselfer newbie franchisor.  I have completed the writing of my UFDD with the help of a downloaded franchise software package and lots of research but I need help with what to do next.  Do I file my initial registration package with the Federal Trade Commission in Washington D.C.?  If so, what address do I send it to or do they have an e-mail address that I send it to? I have not been able to locate these addresses in the course of my research.

I plan to start marketing my franchise offering in the less strict states, the ones that don't require separate filing fees.  Do I still have to register my UFDD with those "easy" states?

You do not file the FDD with the Federal Trade Commission... only with registration states. I, of course, would always recommend you have your documents reviewed by a practiced franchise attorney and can recommend someone if you like. I would also recommend you consider completing the compliance course online at the IFA University... it's a valuable resource to help you understand a number of federal and state laws regarding disclosure requirements (disclosure, delivery & timing), unintentional earnings claims, advertising restrictions, and more.

While the FTC does not require you to file your documents each year, it is important to note that under the FTC Act, the FTC has the right to seek both preliminary and permanent injunctions against rule violations and can, in effect, ban you from franchising. They also have the power to freeze assets, assess civil penalties, and seek monetary redress on behalf of those injured by rule violations.
